Project Description

Senate Bill 9 (Atkins), signed into law on September 16, 2021 and effective January 1, 2022, allows property owners within a single-family residential zone to build two units and/or to subdivide an existing lot into two parcels ("Urban Lot Split"), for a total of four units. In December of 2021, the Cupertino City Council approved objective standards and processes for development and subdivision under Senate Bill 9 through Interim City Ordinance No. 21-2235(PDF, 603KB). The City of Cupertino is now preparing a regular ordinance to establish permanent regulations for two-unit projects and Urban Lot Splits in Single-Family Residential zones. This ordinance seeks to provide guidance both to the public and to the Community Development Department as to two-unit projects and lot splits that qualify for ministerial review (Planning Director approval without a hearing) and to clarify the objective standards and guidelines that proposed development must comply with as part of the ministerial review.

The City invites residents and interested parties to attend the following Public Hearings and meetings and encourages input and feedback on interim objective standards and processes for development and subdivision under Senate Bill 9.
